Overview

Frederick (“Fred”) H. Wen is a Senior Trial Counsel in the Houston Office of Germer PLLC. Fred is passionate about defending and helping clients navigate the legal system. He strives to explain complex legal concepts in simpler terms and to ensure clients and carriers feel confident and informed every step of the way. Fred is an experienced trial litigator with over 20 years of civil litigation experience having first and second-chaired several jury and bench trials at both the federal and state court levels in Texas and New York. He is also an accomplished appellate attorney, having successfully argued several oral arguments before the U.S. Court of Appeals for the Second Circuit, and successfully drafted several briefs in both federal and state appellate courts in New York and Texas. Before joining Germer PLLC, Fred worked at midsize and boutique insurance defense firms and an Am Law 100 firm in Houston, Texas. Fred gained invaluable experience practicing appellate and trial-level commercial trucking and auto personal injury defense, construction defect defense, professional liability/realtor defense, commercial litigation, and bankruptcy law, as well as providing insurance coverage litigation defense and opinions. In addition, Fred previously worked for over fourteen years in the public sector, including over five years as a Central Staff Attorney at the First Court of Appeals in Houston, Texas, and nearly nine years at the New York State Office of the Attorney General in both the Law Enforcement Section of the Litigation Bureau and the Federal Habeas Corpus Section of the Appeals & Opinions Division. After graduating law school, Fred clerked for a federal bankruptcy judge in San Antonio, Texas, and then a federal district judge in Alexandria, Louisiana.

Fred represents insurance companies and individuals, as well as small business owners, corporations, and contractors. Fred’s practice areas include personal injury defense, transportation and trucking litigation, premises liability, construction law, commercial litigation, and appellate law.

Representative Experience

  • He won partial summary judgment on multiple claims in a commercial trucking personal injury case in the Southern District of Texas;
  • He successfully moved to dismiss a construction defect appeal in the Fourteenth Court of Appeals in Houston, Texas;
  • He won dismissal of an appeal in a realtor defense case in the Eighth Court of Appeals in El Paso, Texas;
  • He successfully opposed a motion for new trial following a jury verdict in an auto accident personal injury case in Bexar County, Texas;
  • Filed several appellate briefs before federal and state appellate courts in New York State, and successfully argued five out of six appeals before the U.S. Court of Appeals for the Second Circuit;
  • First and second chaired two federal jury trials involving inmate civil rights claims and second chaired a personal motor vehicle accident jury trial in Bexar County, Texas;
  • First chaired two federal evidentiary hearings, one in an employment case and the other in a habeas corpus case;
  • Successfully moved for summary judgment in a federal putative class action lawsuit involving inmate civil rights claims; and
  • Secured a successful reversal of a federal preliminary injunction entered against New York State’s enforcement of the Bottle Bill amendments which earned the state over $120M annually, at the time.
  • Published Recent Amendments and Caselaw Affecting the Construction Industry in Texas, Gordon & Rees Quarterly Update, Construction Practice Group (March 2022).

Interests

  • Fred is fluent in Spanish and conversationally fluent in Mandarin Chinese and Portuguese.
  • Fred enjoys spending time with his wife, two kids, and schnoodle, traveling, trying out new restaurants, playing basketball, tennis, jogging, biking, or cheering on his Houston Astros, Rockets, Texans, and Rice Owls.
