David L. Merkley joined Germer in 1996 as an associate upon graduating from law school at Baylor University, and was elected as a principal of the firm at the end of 2002. His practice began from the firm’s home office in Beaumont, and has expanded throughout Texas since he moved to the firm’s Houston office in 2001. David is an experienced trial lawyer with a heavy docket of commercial and personal injury defense lawsuits in federal and state court. His clients include Fortune 100 companies, large and small insurers, and insured individuals. From 2005 through 2007, David L. Merkley was selected as a “Texas Rising Star”, a Thompson Reuters publication, which is a peer-review nomination reserved for the top 2.5 percent of lawyers in Texas under age 40. He has consistently thereafter (from 2008-2015) been named a “Texas Super Lawyer”, a Thompson Reuters publication, which is reserved for the top 5 percent of attorneys statewide. He was also recently elected into the American Board of Trial Advocates as one of the youngest members of the Houston Chapter. David has been Board Certified in Personal Injury Trial Law by the Texas Board of Legal Specialization since 2003, and has successfully defended more than 20 jury trials to verdict as lead attorney. He has also recently completed an appointment to the editorial board of the Texas State Bar Journal. While in law school, David was elected to serve on the editorial board of the Baylor Law Review, both as the Senior Notes and Comments Editor and as Assistant Managing Editor. He was also selected to the Baylor Order of Barristers and excelled in Moot Court competitions as a top-15 speaker. David attended the University of Lethbridge in Alberta, Canada in connection with his undergraduate studies and thereafter obtained a Bachelor of Arts degree from Brigham Young University. He is admitted to practice in state and federal courts in Texas as well as the United States Court of Appeals for the Fifth Circuit. David is an active member of the Texas Association of Defense Counsel (Young Lawyers Committee, 1999-2003), Defense Research Institute, State Bar of Texas (Board of Editors, Texas Bar Journal, 2005-2008), and Houston and Jefferson County Bar Associations. He is fluent in Portuguese. He is also a proud parent of two children and an active volunteer in the Boy Scouts of America.
David’s practice is exclusively in civil litigation, including but not limited to transportation and trucking litigation, premises liability, products liability, insurance law, maritime law, personal injury defense, commercial litigation, and employment law.
